DMCA Copyright Policy

Last Updated: October 29, 2026

1. Our Commitment to Intellectual Property Rights

At Porchivy, we respect the intellectual property rights of others and expect others to respect our rights as well.

We are committed to addressing legitimate copyright infringement concerns involving content available on https://porchivy.com.

If you believe that material on our website infringes a copyright you own or are authorized to represent, you may submit a written copyright infringement notice in accordance with the Digital Millennium Copyright Act (DMCA), where applicable.

We review copyright complaints and may remove or disable access to material that is reasonably identified in a valid notice, consistent with applicable law.

This policy explains how to submit a copyright complaint, how to submit a counter-notification if you believe material was removed by mistake, and how we may respond to repeated infringement.

2. How to Submit a DMCA Copyright Notice

If you are a copyright owner or are authorized to act on behalf of a copyright owner, and you believe that material available on Porchivy.com infringes your copyright, please send a written notice to our copyright contact.

Copyright Contact Email: Porchivy@help-contactus.com

To help us review your complaint, your notice should include the following information:

1. Your Signature

Provide a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.

2. Identification of the Copyrighted Work

Identify the copyrighted work you believe has been infringed. If your notice concerns multiple copyrighted works, you may provide a representative list where permitted under applicable law.

3. Identification of the Allegedly Infringing Material

Provide the specific URL or URLs of the material on Porchivy.com that you believe infringes your copyright, along with enough information for us to locate it.

4. Your Contact Information

Provide your full name, mailing address, telephone number, and email address, where available, so we can contact you regarding your notice.

5. Good-Faith Statement

Include a statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.

6. Accuracy and Authorization Statement

Include a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Please provide complete and accurate information. Incomplete notices may delay our review or require us to request additional details.

Before submitting a notice, please consider whether the use may be authorized by a license, permission, or a legal exception such as fair use.

3. How We Handle Copyright Complaints

After receiving a copyright notice, we may take the following steps, as appropriate and consistent with applicable law:

  • Review the information provided to determine whether the notice sufficiently identifies the copyrighted work and the allegedly infringing material.

  • Request additional information if the notice is incomplete or clarification is necessary.

  • Remove or disable access to material identified in a sufficiently complete notice when appropriate.

  • Notify the person or party responsible for the material, where applicable.

  • Consider a valid counter-notification if one is received.

  • Take further action where necessary to address repeated or ongoing infringement.

Submitting a notice does not guarantee that material will be removed. Our response will depend on the information provided, the circumstances of the claim, and applicable law.

We may retain records relating to copyright complaints and our responses where reasonably necessary for legal compliance, dispute resolution, or protection of our rights.

4. Counter-Notification Procedure

If you believe that material you provided or made available on Porchivy.com was removed or disabled as a result of mistake or misidentification, you may be eligible to submit a DMCA counter-notification.

A counter-notification must be submitted in writing and should include the following information:

1. Your Signature

Provide your physical or electronic signature.

2. Identification of the Removed Material

Identify the material that was removed or disabled and describe where it appeared on our website before removal.

3. Statement of Good-Faith Belief

Include a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

4. Your Contact Information

Provide your name, address, and telephone number.

5. Jurisdiction and Service of Process

Include the statement required by applicable DMCA law consenting to the jurisdiction of the appropriate U.S. federal district court. If you are located outside the United States, the statutory jurisdiction requirements applicable to an overseas subscriber apply.

You must also agree to accept service of process from the person who submitted the original copyright notice or that person's authorized agent, as required by applicable law.

Please send your counter-notification to:

Email: Porchivy@help-contactus.com

We may request additional information if necessary to assess whether the counter-notification meets the applicable requirements.

5. Review of Counter-Notifications

When we receive a counter-notification that satisfies the applicable legal requirements, we will review it and follow the procedures required by law.

Where the statutory DMCA counter-notification procedure applies, the original complaining party may be notified and provided with relevant information from the counter-notification.

Under the applicable DMCA process, material that was removed or disabled may be restored between 10 and 14 business days after receipt of a valid counter-notification, unless the designated agent receives notice that the original complaining party has filed an action seeking a court order to restrain the allegedly infringing activity.

The applicable statutory requirements and circumstances will determine whether and when material may be restored.

Submitting a counter-notification does not guarantee that material will be restored.

6. Repeat Infringement

Porchivy respects intellectual property rights and does not condone repeated copyright infringement.

Where applicable to our services and consistent with the DMCA and other applicable law, we may restrict or terminate access or accounts associated with repeated infringement.

We may consider the circumstances of each case, including the number and nature of substantiated complaints and any relevant counter-notifications.

We reserve the right to take appropriate action when repeated or serious infringement is identified, subject to applicable law.

7. Misrepresentation and Abuse of the DMCA Process

Copyright notices and counter-notifications must be submitted in good faith and must contain accurate information.

Knowingly making material misrepresentations in a copyright notice or counter-notification may result in legal liability under applicable law, including Section 512(f) of the DMCA.

Please do not submit a copyright complaint unless you have a legitimate basis for believing that your copyright has been infringed.

Likewise, do not submit a counter-notification unless you have a good-faith basis for believing that the material was removed or disabled because of mistake or misidentification.

We may take appropriate action in response to abusive, fraudulent, or knowingly misleading submissions, consistent with applicable law.

8. Other Intellectual Property Concerns

This policy addresses copyright concerns under the DMCA.

If your concern relates to a trademark, patent, privacy issue, or another legal matter, please identify the nature of your concern when contacting us. Different procedures or legal requirements may apply.

Please provide sufficient information for us to understand the issue and direct it to the appropriate review process.
